Meal Allowance in Fast Food — Am I Entitled?

You may be entitled to a meal allowance if you are required to work overtime without prior notice. Under the Fast Food Industry Award, a meal allowance is payable when overtime exceeds 1.5 hours and you were not notified the previous day.

The rule

The Fast Food Industry Award (MA000003) provides for a meal allowance when an employee is required to work overtime of more than 1.5 hours and was not informed by the end of the previous day or shift that overtime would be required. The allowance is designed to cover the cost of purchasing a meal when you cannot plan ahead. The current meal allowance amount is indexed annually — check the current rate as it increases each year on 1 July.

What you should be paid

Grade 1, asked to stay 3 hours overtime without prior notice

  • Overtime rate (150%): $39.83/hr
  • 3 hours overtime pay: $119.49
  • Meal allowance (approx): $15.20
  • Total owed: $134.69

Without the meal allowance, you're short $15.20. Many employers miss this entitlement entirely.

Do I get a free meal during my shift?

The Fast Food Industry Award does not require employers to provide a free meal. However, many fast food chains offer discounted or free meals as a company policy. If your employer provides a meal benefit, it cannot be used to offset or reduce your hourly rate below the award minimum.
